Illinois Property Tax Appeal Board Rules in Favor of Homeowner in DeWitt County Case

In a recent decision by the Illinois Property Tax Appeal Board (PTAB), a DeWitt County homeowner successfully challenged their property tax assessment, leading to a reduction in the assessed valuation. The case highlights critical issues surrounding assessment equity and the practice of “sale chasing” by taxing authorities.

Background of the Appeal

The homeowner filed an appeal contesting the assessment of their property, a 15.62-acre farm with a two-story residence, citing both inequity in assessment and improper valuation methods. The appeal was made after the property’s assessment saw a significant increase following its purchase, raising concerns that the valuation was not based on a uniform methodology.

To support their claim, the appellant presented eight comparable properties located in the surrounding area, demonstrating discrepancies in assessment rates compared to their own home. Additionally, evidence was submitted showing that non-sold properties in the area had not experienced similar assessment increases.

Key Issues: Sale Chasing & Assessment Inequity

One of the major arguments in the case was the practice of "sale chasing"—where assessors increase property valuations following a sale, despite the absence of improvements or significant market-wide changes. In this case, the appellant provided testimony and documentation indicating that:

  • The home’s assessment was raised significantly after its purchase.
  • The local assessor admitted that the increase was due to the sale price.
  • Comparable properties that had not sold remained at lower assessment levels.
  • The county failed to justify the assessment increase using standard mass appraisal techniques.

PTAB’s Decision: Reduction in Assessment

After reviewing the evidence, the PTAB found in favor of the appellant, determining that the property was assessed unfairly and should be reduced. The Board agreed that the assessment was increased due to the sale and that the homeowner had provided clear and convincing evidence of unfair treatment.

As a result, the PTAB ordered a reduction in the home’s assessed value, aligning it more closely with comparable properties and ensuring fair taxation.
